If you are under the age of 18 and you are accused of committing a crime, you will probably face charges in Pennsylvania's juvenile law system. Some crimes are so serious, however, that teenage offenders will be certified as adults and their cases will proceed to criminal court.
Where your case is tried will be determined at your preliminary hearing. If they decide to prosecute you as an adult, I can file a motion seeking to decertify you and send the case back to juvenile court, which is much more lenient. There are things you can do to keep the charge down, but you must act quickly.
Even if we do not win your juvenile case outright, there are a lot of alternative sentencing options. We may be able to arrange for you to participate in a class or rehab, and possibly have your charge expunged and wiped off your record. You cannot assume that your record will be sealed automatically. You must take proper steps to protect it.
License Suspension
Drug possession, underage drinking, and other charges can often lead to an automatic license suspension. While the court may tell you that the consequences of a conviction will disappear after you turn twenty-one, PennDOT will maintain a record of your license suspension and why it was suspended. This information will remain public unless it is properly sealed, and it can have a far-reaching effect.
