If someone has been gravely injured or killed in a car accident, and you were charged with DUI in the process, you could face DUI homicide charges. However, just because there was a car accident and a DUI does not mean that the two were related. The fact that you were drinking does not automatically make you more or less responsible.
In order to be charged with homicide by DUI, your drunk driving has to be the cause of death. For example, if you were driving down the road and another car crossed over from the other lane and crashed into your car, you would not be responsible for their injuries or death. The prosecution must show that you were responsible for the accident.
